OSHA Rule Regarding Confined Spaces “Hooked” In Texas

Recently, the Texas Association of Builders (“TAB”) filed a petition in the Fifth Circuit Court of Appeals seeking a review of a newly finalized OSHA rule, which was aimed at reducing confined space risks in construction activities.  The TAB petition potentially hinders the rule’s implementation, delaying years’ worth of the rule’s development by the Bush and Obama Administrations. The Informal Conference: To Settle or Not To Settle

An important right upon receipt of an OSHA citation is to request an informal conference with the OSHA area director. Notably, an informal conference must be held within 15 working days of your receipt of the citation. (This is the same deadline as for contesting the citation.
